Protection against caste discrimination best achieved by emerging case law

The Government has published its response to the public consultation about how to ensure that there is appropriate and proportionate legal protection against unlawful discrimination because of caste.  When asked about the preferred option to provide protection against caste discrimination, 8,513 respondents were ‘in favour of relying on case-law’ and 2,885 respondents were ‘in favour of legislation’. The Government therefore believes that the best way to provide the necessary protection against unlawful discrimination because of caste is not by making caste a protected characteristic under the Equality Act 2010, but by relying on emerging case-law as developed by courts, as this is a more proportionate approach given the very low numbers of cases involved.
