A reminder that under The Trade Union and Labour Relations (Consolidation) Act 1992 (Amendment) Order 2013, the minimum period for collective redundancy consultation, with the appropriate employee representatives, will be reduced from 90 to 45 days, where proposals are made, on or after 6th April 2013, to dismiss 100 or more employees at one establishment by reason of redundancy within a period of 90 days [this figure remains unchanged] or less. In addition, from 6 April 2013, fixed-term contracts that have reached their agreed termination date are excluded when calculating whether or not there is a requirement to consult collectively. Acas will be producing new non-statutory guidance on key issues affecting redundancy consultation and have confirmed that it will be published by 6 April 2013.
